Content Provider Agreement

1. Eligibility and age verification

You represent that you are at least 18 years old (or the age of majority where you live, if higher). You agree to verify your legal age and identity with a valid government-issued photo ID through the verification process we specify, before your first publication and again whenever we ask. You may not let anyone else use your creator account.

2. Persons depicted in your content

For every person who appears in any content you upload, including yourself, co-stars, and anyone visible in the background, you agree to:

• Verify that they are at least 18 years old by inspecting a valid government-issued photo ID and keeping a copy.
• Obtain and keep on record their written consent (a) to be depicted in the content, (b) to the public distribution of the content and its upload to CosplayXclusive, and (c) where the content can be downloaded, to its download by other users.
• Provide those records to us, our payment processor or the card networks within 48 hours of a request.
• Remove content promptly if a person depicted withdraws consent, and cooperate with our Content Removal & Appeals Policy.

A model release template that satisfies these requirements is available; you may use your own equivalent form.

3. Prohibited content

You will not upload, stream, message or market any content that is illegal where you or your audience are located, or that violates the standards of Visa, Mastercard or our payment processor. In particular you will not upload content that depicts, describes or suggests:

• Anyone under 18, real or simulated, in any context, including characters portrayed as minors and age-play or "teen"/"lolita"/"schoolgirl" framing.
• Non-consensual sexual activity, including depictions of rape, forced or coerced acts, or persons who are asleep, unconscious, intoxicated, drugged, hypnotised or otherwise unable to consent.
• Incest, including step-family and role-play framing.
• Bestiality or any sexual contact with animals.
• Bodily excretions (urine, faeces, vomit, menstrual blood) in a sexual context.
• Extreme violence, blood, gore, asphyxiation, strangulation, suffocation, mutilation, snuff or torture, real or simulated.
• Prostitution, escorting, or any exchange of money for in-person sexual services, or content depicting such an exchange.
• Human trafficking, kidnapping or abduction themes.
• Content that uses the name, likeness or branding of a real celebrity or public figure without their consent, or that is marketed as "celebrity" content.
• Content recorded or shared without the knowledge and consent of a person depicted (voyeurism, hidden camera, "revenge" content).
• Hate speech, harassment, threats, weapons used to threaten, or the promotion of illegal drugs.
• Content you do not own or have a licence to distribute.

The same restrictions apply to captions, hashtags, titles, usernames, bios and messages. Our systems reject wording associated with these categories, and we may require you to rephrase.

4. Ownership and licence

You keep ownership of your content. You grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, watermark, transcode, display and distribute it through the Platform, to create blurred previews and thumbnails, and to retain copies as required for legal, safety and card-network compliance. The licence ends when the content is deleted, except for those retained copies.

5. Moderation, records and cooperation

• All uploads are screened automatically before publication and may be reviewed by our moderators at any time.
• We may remove content, restrict features, hold payouts, suspend or terminate your account for any violation of this Agreement, the Terms, or our partners' standards, and we will report illegal content to the authorities.
• You will respond to consent, identity or complaint enquiries from us within 48 hours.
• You will keep your consent and ID records for at least seven years after the content was last available.

6. Earnings and payouts

We retain the platform fee communicated to you at approval on every transaction. Earnings become payable once the underlying payment has cleared and any hold period required by our payment processor has passed. Refunds, chargebacks, fraud reversals and fees charged to us because of your content are deducted from your earnings. We may withhold payouts while a complaint, chargeback or compliance review involving your content is open. You are responsible for your own taxes and for supplying any tax forms we request.

7. Indemnity

You will indemnify and hold harmless Aquarix LLC, its officers, employees and payment partners from any claim, fine, penalty or loss arising from your content, your breach of this Agreement, or any person depicted in your content claiming that consent was not given.

8. Term and termination

This Agreement applies for as long as you hold a creator account. Either party may end it at any time; you by closing your account, we by written notice. Sections 2, 4 (retained copies), 5, 6 and 7 survive termination.

9. Changes

We may update this Agreement. When we do, the version date above changes and you will be asked to accept the new version before you can publish again. Continued use after acceptance constitutes agreement.

10. Governing law and contact

This Agreement is governed by the laws of the State of Delaware, United States, and disputes are resolved as set out in the Terms. Questions: contact@cosplayxclusive.com.
